Draft — not yet reviewed by a lawyer
This document was drafted for the software and describes how it actually works, but it has not been reviewed by a lawyer and does not establish that The Lotto is lawful in any jurisdiction. The operator must have it reviewed by qualified counsel before launch. Bracketed items are details only the operator can supply.1. Who we are
This website and its interface to The Lotto Solana program are provided by [OPERATOR LEGAL NAME] (“we”, “us”), [REGISTERED ADDRESS AND JURISDICTION OF INCORPORATION]. Contact: [CONTACT EMAIL].
2. Accepting these terms
By using this website, or by acquiring or holding $LOTTO in order to take part in drawings, you agree to these terms, the Risk Disclosure and the Privacy Policy. If you do not agree, do not use the website and do not participate.
3. Eligibility and restricted jurisdictions
- You must be at least 18 years old, or the age of majority where you live if that is higher.
- You may not use the interface or participate if you are located in, or a resident or citizen of, any jurisdiction where lotteries, games of chance or this token are prohibited or require a licence that has not been obtained, including: [LIST OF RESTRICTED JURISDICTIONS — to be determined by counsel].
- You may not participate if you are subject to sanctions or acting on behalf of a sanctioned person.
- You alone are responsible for determining whether participation is legal for you. We do not claim, and nothing here should be read as claiming, that The Lotto holds any licence, approval or registration.
4. What the service is
The Lotto is an open-source program deployed on the Solana blockchain. Holding the $LOTTO token in a self-custodied wallet makes that wallet eligible, under on-chain rules, for periodic prize drawings. This website is an interface that displays on-chain data and helps you build transactions that you sign yourself. We never take custody of your tokens or keys.
How drawings work is decided by the program and the rules stored on-chain, which are frozen into each round when it opens. If anything on this website, including these terms, differs from what the program does, the program's behaviour is what happens; these terms cannot change a round that is already running.
5. Drawings and prizes
- Outcomes are random. Most holders will not win any given drawing. Past results do not predict future results.
- The prize of each round depends on the funds actually present in the on-chain prize vault when the round's snapshot is committed. No minimum prize is promised.
- Prizes are paid on-chain by the program directly to the winning wallet. Anyone can trigger the payment; nobody, including us, can redirect it. We will never ask you to send funds or sign anything to receive a prize.
- A round can include at most 131,072 eligible wallets (the winner's proof must fit in one Solana transaction). A round with more is cancelled instead of drawn.
- Drawings may be delayed, cancelled or paused as described on the How it works and Security pages. A cancelled round's prize stays in the vault for later rounds; it is not refunded or paid to anyone.
6. Risks
Using crypto tokens and smart contracts carries significant risk, including total loss. Read the Risk Disclosure, which forms part of these terms.
7. Prohibited conduct
- Attempting to manipulate snapshots, randomness or the program, or exploiting bugs instead of reporting them.
- Using the interface for money laundering, fraud, or to circumvent jurisdictional restrictions (for example with a VPN).
- Impersonating The Lotto or distributing look-alike tokens.
8. No advice; fees; taxes
Nothing on this site is financial, investment, legal or tax advice. We charge no fee through this interface; Solana network fees and any DEX fees apply. You are responsible for any taxes on prizes or token transactions.
9. Third-party services
The service relies on independent third parties, including Solana validators and RPC providers, Meteora (liquidity), ORAO (randomness), wallet providers and market-data APIs. We do not control them and are not responsible for their availability or conduct.
10. Availability of the website
We may change, suspend or restrict access to this website at any time, including for particular regions, without notice. The on-chain program does not depend on this website: rounds already committed can be revealed and paid by anyone (payment waits while the lottery is paused), and the Transparency page explains how to verify drawings independently.
11. Disclaimer and limitation of liability
To the maximum extent permitted by the law that applies to you:
- The website, the open-source software and all information on this site are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy or uninterrupted availability.
- We are not liable for losses arising from: the Solana network, validators, RPC providers, wallets, Meteora, ORAO or other third parties; bugs or exploits in smart contracts; changes in the value of $LOTTO or any prize asset; loss of your keys or seed phrase; transactions you sign; delays, pauses or cancellations of drawings; or participation where it is unlawful for you.
- We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill.
- Our total liability for all claims relating to the service is limited to 100 US dollars.
Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, such as liability for fraud, or for death or personal injury caused by negligence, and nothing affects rights you have as a consumer that cannot be waived.
12. Changes, governing law and disputes
We may update these terms; the date at the top will change, and using the website or participating after an update means you accept the updated terms. These terms are governed by [GOVERNING LAW — to be chosen with counsel]. Disputes will be resolved by [COURTS OR ARBITRATION — to be chosen with counsel], without affecting any mandatory consumer-protection rights in the country where you live. If a provision is found unenforceable, the rest of these terms remain in effect. Rules enforced by the on-chain program are public and are not changed by these terms.
